terry mcsweeney is live at the new apple store and everybody is wondering what it will mean for the direction of apple. >> yeah, steve jobs built apple into the number one tech company in the world. now, in a very brief resignation letter he left a whole lot more questions. he didn't give a whole lot of answers. what business snelth who is the new guy? let's take a look at man who built it. he has been compared to a modern day thomas edison, synonymous with ipad and phone. he says he can no longer fulfill his duties as ceo. he is still chairman of the board but not on the day to day hands on. he did have a liver transplant but he did not mention health problems. the new ceo, tim cook, former chief operating officer moves over as ceo. had here is some observations on

cook and jobs. >> he is iconic. he represents part of apple. frankly it's going to be hard i think moving on. >> i admire him and i'm glad to hear he stepped down. >> i think it's big. he is apple. >> reporter: taking a look at the scene at the store when they opened. they didn't have any fantastic giveaways it was just apple opening a store in berkeley and people came out. there was the usual hoopla that goes along with anything apple. steve jobs did an amazing job, approval rating of 97% making him the third most popular ceo of all time. still a lot of questions to be answered. we hope to find out more as the day goes on. this morning, news about jobs is not going over well on

wall street. in after hours trading, apple stock fell more than 5% that is $19 a share or $18 billion in value. we posted steve jobs' resignation letter along with tweets reacting to the news. that is at abc7news.com. former giants slugger barry bonds will be back in federal court today with a pitch of his own. he'll try to convince a judge to throw out his felony conviction for obstructing justice. amy hollyfield is live at federal courthouse in san francisco with the story. >> this is a big one. he is now convicted of a crime he would like to change that. he would like to ask the judge to set the conviction aside. he looks like he is doing okay. he made a rare appearance at giants game last night. he held up a ball that they signed and gave him. he was convicted in april of

obstructing justice because what he said to a grand jury. he was asked whether his former trainer ever gave him anything that required a syringe. bonds' answer rambled on and on and jury convicted him. unauthorized rambling is not a crime. but jury foreman did say that the jury did under the charge. the judge will have to consider all of this as she is asked to set conviction aside. prosecutors have a big decision to make, likewise, to retry him for the obstruction of justice charges. jury was hung on those charges and declared a mistrial so no word on whether prosecutors will make the decision today, but it's a decision everybody is watching for. today is going to be a big day in court today. potential for being bigger depending on what prosecutors say.

live in san francisco, amy hollyfield, "abc 7 news." this morning, thousands of families in placer county who were under a mandatory evacuation are back in their homes after fire crews allowed a rail tanker to burn itself out. let's take a live look. you can see they are still spraying water to keep it cool. the fire chief says there is still propane inside the tank and continue to shoot water on it for few more hours. he says there is no longer a threat of a major explosion as there was when the flames were burning like that. it remains unclear how the tanker caught fire on tuesday afternoon in the northern propane energy yard. a state assembly committee will consider a senate bill that calls for replacing the death penalty in california with life in prison. they approved the measure last month. they believe the death penalty

does not reduce crime and costs too much. they argue that california has spent more than $4 billion on just 13 executions since reinstating the death penalty in 1978. if the bill becomes law, they would close death row in san quentin. >> the f.b.i. in pinole police are trying to figure out if two men behind a deadly car robbery are behind two other bay area heists. it targeted a loomis armored truck. they killed one suspect and wounded another in a shootout. one officer was shot and wounded. investigators are trying to determine if the two suspects are responsible for robbing an armored car warehouse earlier in the month. two masked men followed them into buildings and made off with

cash. the two brothers may be linked to the may 25th robbery of a brinks armored car in richmond. >> san jose police department has ended the controversial deployment of homeland security officers. the department launched operation community shield to battle an increase in gang violence and city's highest murder rate. since june, officers have made more than 300 arrests, 70% of them gang-related. police plan to continue their collaboration with the mayor's gang prevention task force. >> 5:08 and you will probably see mist on your way to work this morning. >> especially if you travel through some of the higher elevations, even down at the water level, i found some drizzle on my way to work. you can see the cooling trend is on the way. take a look at some of the temperatures around today. you can see the highs are going to be much cooler than

insulation of more at&t utility boxes. they are asking the court to order a review and stop the boxes from being installed while the case is pending. they say the boxes are an eyesore and block the pathway of pedestrians when they cross the street. at&t boxes hold the equipment for digital tvs and high-speed internet. last month the board of supervisors passed a measure to allow the boxes without conducting an environmental review. there is a crisis in america it's hunger. 50 million americans live in food insecure households but there are food banks that are helping. you can make a difference, as well. don sanchez checks in with this report on hunger at home. it is a familiar story. families work hard but with expenses their dollars don't far

oakland school board members to change their minds to promoting an officer to the district police force. he was involved in a deadly shooting earlier this year. i'm eric thomas. topping the news the man behind the i-pod and iphone is no longer behind the bosses desks. he resigned yesterday and everybody is wondering if health is the reason. terry mcsweeney is live at the new apple store in berkeley. >> reporter: it would make all the sense in the world. this is a man who has been very sick over the past several years. a lot of speculation that is it his health. in the letter of resignation, he says he is no longer of capable of fulfilling the duties and expectations of the ceo. there is another explanation. take a look at the man who made apple the number one high-tech company in the world. man that brought us i

everything. sit a health issue. there is no mention of it in the resignation letter. he had a liver transplant in 2009. tim cook is the new man, apple's chief operating officer now the ceo but what is apple going look like now? in a rare interview back in 2007 this is at the time when he was launch is the first iphone what if there came a time when there was no next big thing in high tech. >> we don't worry about stuff like that. we try to build products that we think are wonderful and people might want. sometimes we're right and sometimes we're wrong. i think we're going to hit a grand slam with this. >> reporter: he was right about that. these are pictures la last weekend when this apple store here in berkeley opened.

the crowds lined up for hours just to be the first in. there wasn't a new product available but there may be soon. as far as why he is doing it, why he is resigning people are saying he may have a recurrence of cancer that he had. there may be a problem with his liver, but moto.com it might be a perfect time to resign. he has got the number one high-tech company in the world. he is one of the most popular ceos of all time. they would be an ideal to step down. you have to be rooting routing that article is correct. most people are weighing in medical reason. stocks are down 5% in overnight trading. it will be interesting to see what happens on wall street when it opens this morning. we will be watching.

later today, barry bonds will take a swing at getting his conviction thrown out. former giants slug er and legal team will be in federal court in san francisco today. amy hollyfield is there and she is live with more on the story. >> he faces serious business here in court he had a little fun last night. barry bonds actually went out and watched his former team. it is rare for him to make appearance for giants games. he held up a baseball that the two giants announcers gave him. he would like his conviction for obstruction of justice set aside. he was convicted because of what he told a grand jury. he gave a very long answer to one question and prosecutors called it evasive but his defense attorneys are now saying that excessive rambling is not

the job following the retirement of pete sarna. today a state senate committee is scheduled to vote on to ban the sale of shark fins in california. it would force plants to empty their stock of shark fins by the end of next year. they say it unfairly targets asian culture that has use the fins for soup. leland lee has opposed the bill. they say sharks are mutilated by fisherman. >> it's 5:36 and mist and drizzle out there in spots and make way for the sun later on today. mike, is it going to be as warm as it was yesterday? >> i don't think so. cooling trend that started yesterday will continue to deepen across the bay area. several areas of low pressure

exam. schools like burton in san francisco have had a strategy in place to make sure more of their students pass the test. >> burton, we've been able to configure figure teacher schedules that best and brightest teachers work with the most vulnerable kids. >> they must pass the english and math portions in order to get a diploma. they can start taking the exam in the tenth grade and have several more chances to pass. those making steady increases were african-americans and latinos. among african-americans, 83% of the class of 2006 passed the exam, compare that with today, more than 90%. among hispanics, 85% of the class of 2006 passed the test compare that with today's numbers, more than 92%. >> 98% of graduating white students pass the exit exam but

last is 101 mile-an-hour winds in bahamas. its category 3, major hurricane with those winds. going to the northwest at about 12 miles an hour. it's going through the bahamas and taking a little bit of a jog to the north so folks in florida that recurve to the north and eventually the northeast is going to take place. let's take a look at the latest hurricane track, looks like irene will pick up steam and be a category 4 hurricane later today and tomorrow. should hit cape hatteras as a category 3 and then once it passes there, the cooler ocean waters will drop it down to possibly a tropical storm as it rolls near new york and possibly hart to ford connecticut. it will be interesting to see. first hurricane up in new england in a long time. >> bring it back home and take a look the cloud cover, vollmer
